Speak With An Attorney Immediately
1. Right To Not Speak With The Police
The 5th Amendment of the United States Constitution provides you with a right against self-incrimination
The fact that you do not speak to the police or answer their questions CANNOT be used against you in a criminal prosecution.
Only speak with your attorney about your case.
You have a constitutional right to have an attorney present during police questioning.
If the police ask to speak with you about a case, you have the right to tell the police that you want an attorney and the right to not speak to the police or answer the police's questions.
Even providing the police with simple information that may not seem important or incriminating to you may be the lynchpin in sealing a case against you.
If the police are physically present or you are at the police station, you may ask the police if you are under arrest. If the police tell you that you are not under arrest, you may request that the police release you.
Police statements to you may not be accurate.
2. Right To Not Consent To A Search
The 4th Amendment of the United States Constitution provides you with a right against unreasonable searches and seizures. In almost all cases, it requires the police to obtain a warrant before they may search your home or work. Depending upon the circumstances, the police may also need a warrant to search your car and other places.
The police are only entitled to a search warrant under limited circumstances.
Just because the police tell you they will get a search warrant unless you permit the police to search does not mean that a judge will actually provide the police with a search warrant.
You may inform the police that they may not search your home, work, computer, car, or any other place or item until the police have a valid search warrant or you have spoken to an attorney.
A court should suppress illegally seized evidence.
